These Terms of Service ("Terms") govern your access to and use of TakeCtrl("TakeCtrl," "we," "us," or "our"). By using our website or product, you agree to these Terms.

If you do not agree to these Terms, do not use TakeCtrl.

1. What TakeCtrl Does

TakeCtrl is a macOS application designed to help you take control of your workflow. Features may change, improve, or be removed over time as the product evolves.

2. License

Subject to these Terms and a valid license, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use TakeCtrl on your device.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, except where permitted by applicable law.

3. Your Responsibilities

You agree not to use TakeCtrl to:

• Violate any law or regulation.
• Infringe intellectual property, privacy, or confidentiality rights.
• Harm, harass, defraud, or impersonate others.
• Use the product in a way that could damage, disable, or interfere with macOS, other apps, or third-party services.

4. Intellectual Property

All content on TakeCtrl — including text, graphics, logos, icons, images, and software — is the property of TakeCtrl or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

5. Purchases and Refunds

TakeCtrl may be sold as a one-time purchase through our payment provider. After a successful purchase you will receive access to download the app and a license key required to activate it.

Because TakeCtrl is a digital product delivered electronically and made available immediately after purchase, all sales are final by default. If you experience a serious issue that appears to be caused by us, please contact us and we will review the situation on a case-by-case basis.

6. Updates and Changes to the App

We may update, modify, improve, suspend, or discontinue any part of TakeCtrl at any time. We are not obligated to provide updates, maintenance, support, or compatibility with all past or future macOS versions.

7. Privacy

Your use of TakeCtrl is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. No Warranties

TakeCtrl is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of TakeCtrl. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

10. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from or related to your use or misuse of TakeCtrl or your violation of these Terms.

11. Termination

You may stop using TakeCtrl at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and governing law.

12. Third-Party Services

TakeCtrl may contain links to or rely on third-party services. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services may be subject to their own terms and privacy policies.

13. Governing Law

These Terms are governed by applicable law without regard to conflict-of-law principles. Any disputes will be resolved in the competent courts of the applicable jurisdiction.

We may update these Terms from time to time. Your continued use of TakeCtrl after the updated Terms become effective means you accept the updated Terms.
